Australia Immigration Program

The Australian immigration program has opportunities for people with a variety of backgrounds, ages, qualifications and needs. Select the immigration/visa program to Australia that best fulfils your aspirations and goals:

General Skilled Migration (Skill Select)

Skilled migration visas provide one of the best opportunities for skilled workers to live and work in Australia. Under the Australian General Skilled Migration program, skilled migrant and skilled worker applicants can use their qualifications, work experience and language ability to meet the Australian immigration requirements for a permanent Australia visa.

Australian government follows the skilled worker program, called the Skilled Migrant Selection Register, known as SkillSelect. In order to apply, you need to submit an Expression of Interest (EOI). The SkillSelect will work as an electronic two-stage process where prospective visa applicants first submit a claim for skilled migration through an online EOI. Following this, applicants may then be invited to submit an Australian visa application on the basis of their EOI.

Australian visa applicants will be selected based on their points test score in a number of selection criteria. All prospective visa applicants will be required to meet the relevant English language requirements and obtain the necessary skills assessment prior to their EOI submission.

Skilled Independent visa (subclass 189)

This points-based visa is for skilled workers who are not sponsored by an employer, a state or territory, or a family member. With this visa, you can live and work permanently anywhere in Australia and eligible family members can be included in your application. This is a permanent visa and allows visa-holders to remain in Australia indefinitely with full work rights.

To be able to submit a valid application for this visa you need to first submit an Expression of Interest through SkillSelect. You can do this in or outside Australia.

Applications are by invitation only. To be invited to apply, you must:

•  submit an Expression of Interest
•  have an occupation that is on the relevant skilled occupation list
•  have a suitable skills assessment for that occupation
•  be older than 18 and less than 50 years of age when the invitation is issued
•  meet the English language requirements
•  be able to score at least 60 on the points test.

If you are invited to apply for this visa, you will then have 60 days in which to submit your online application. Your invitation letter will explain the process you should follow. Invitations are based on claims made in your Expression of Interest at the time you are invited to apply. Your application must reflect the information provided in your Expression of Interest, and be supported by relevant evidence.

Family

You can include the following family members in your visa application:

•  your partner
•  your or your partner’s dependent child
•  your or your partner’s dependent relative.

Benefits

This visa allows you and your accompanying family members to:

•  live and work permanently in Australia
•  study in Australia
•  enrol in Medicare, Australia’s scheme for health-related care and expenses
•  access certain social security payments
•  apply for Australian citizenship (subject to residency criteria)

Skilled –State Nominated Visa (subclass 190)

State Nominated Visa is a points-based Permanent Residence Permit for skilled experts and trades people who have nominations from an Australian territory or a state. The visa holders may reside and get professionally involved anywhere throughout the specific sponsoring state/territory eligible family members can be included in the application.

To be able to submit a valid application for this visa you need to first submit an Expression of Interest through SkillSelect. You can do this in or outside Australia. If you are nominated by a state or territory and meet the basic requirements for this visa, you will then receive an invitation to apply.

There are basic requirements you must meet to apply for this visa. You must: be invited to apply

•  be older than 18 and less than 50 years of age when the invitation is issued
•  nominate an occupation that matches your skills and qualifications and is on the relevant skilled occupation list.
•  have your skills assessed by the relevant assessing authority as suitable for your nominated occupation
•  have at least competent English
•  score at least 60 on the points test
•  score at least 60 on the points test

If you are invited to apply for this visa, you will then have 60 days in which to submit your online application. Your invitation letter will explain the process you should follow. Invitations are based on claims made in your Expression of Interest at the time you are invited to apply. Employment obligations

There are some obligations that states or territories will require you to meet. These include that you:

•  stay in that state or territory that nominated you for at least two years
•  keep the state or territory informed of any changes to your address
•  complete surveys and provide information when asked.

Priority processing arrangements apply to this visa. They determine the order in which Australian immigration considers applications regardless of when they have been submitted.

Australia Skilled – Sub Class 489

Candidates Unable to qualify under the selection criteria for either Australia Skilled independent (Sub-class 189) or Australia Skilled State Sponsored (Sub-class 190) for any given reason, can submit a petition for Australia Skilled –Regional Nominated or Sponsored (Provisional) (subclass 489) Visa.To be able to submit a valid application for this visa you need to first submit an Expression of Interest through SkillSelect. Under this visa, you can either be nominated by a state or territory government or be sponsored by an eligible relative.

•  have your skills assessed by the relevant assessing authority as suitable for your nominated occupation

•  meet the health and character requirements.

Visa Benefits

You get several benefits such as:

•  Reside in Down Under for a maximum of 4 years.

Visa obligations

There are obligations that your nominating state or territory will require you to meet. These include that you:

Sponsored by an eligible family member

You must live and work in a designated area. If you plan to seek permanent residence, you will need to prove that you have spent the specified time in a designated area.

If you do not comply with the conditions of your visa:

•  your visa, and those of any accompanying family members, may be cancelled
•  you will not be able to apply for another provisional Skilled Regional Sponsored visa
•  you may not meet the requirements to apply for permanent residence.

Eligible Sponsors

A sponsor must be at least 18 years of age who resides in Australia as one of the following:

•  an Australian citizen
•  an Australian permanent resident
•  an Eligible New Zealand citizen.

You or your partner must be related to your sponsor as:

•  a child – including a stepchild, or
•  a parent – including a step parent, or
•  a brother or sister – including adoptive or step-sibling, or
•  a niece or nephew – including adoptive or step-niece or nephew, or
•  an aunt or uncle – including adoptive or step-aunt or uncle, or
•  a grandparent or first cousin.

Family Sponsored Visa

This visa is for partners of an Australian citizen, permanent resident or eligible New Zealand citizen, who intend to enter Australia either through marriage or de facto relationship with their partners. This visa is processed in two stages, the applicant will be initially granted a temporary visa till the decision on permanent visa is made and the applicant will be allowed to eventually apply for permanent visa if he/she continues to meet with the visa requirements. The basic requirement is to obtain a sponsorship from an eligible sponsor. The visa categories are as under:

Employer Nominated Migration

ENS (Employer Nomination Scheme) is a PR Visa along with a job offer. It is sponsored by an Australian Employer. allowing them to recruit permanent, highly-skilled staff from overseas or from people temporarily in Australia, when the employers have been unable to fill a vacancy from within the Australian labour market or through their own training programs.

Features of the ENS

•  You and any dependent family members included in the visa application will live as permanent residents in Australia.
•  As permanent residents, you will be able to study in Australia at school or university
•  You will have access to healthcare through Medicare and the Pharmaceutical Benefits Scheme (PBS)
•  You will have access to certain social security payments; this is subject to waiting periods.
•  You will be eligible for Australian citizenship
•  You be will be able to sponsor your family for permanent residence

Regional Sponsored Migration Scheme

The Regional Sponsored Migration Scheme (RSMS), is to help employers who live in areas AWAY from the large cities to find skilled workers. If your business is in a city area, please use the above-mentioned visa instead.

As a migrant applicant, you must be prepared to live in a country area or one of the smaller capital cities. Country areas are beautiful and the people very friendly and helpful to new arrivals. This visa is for skilled workers from outside Australia or skilled temporary residents who live and work in regional Australia.

Skilled migration points test requirements under Skill Select

The three points-tested skilled migration visa subclasses (189, 190 and 489) will continue to require intending migrants pass a points test to be invited to apply for a visa. Under Skill Select, the ability to meet the points test mark will not guarantee an invitation to apply. Invitations will be issued periodically to the highest ranking expressions of interest subject to occupation ceilings.

Under The Australian General Skilled Migration program You must score at least 60 points as per criteria given below. •  Age – you must be 50 years of age or under when you apply.
•  English language – you should have sufficient ability in the English language to work in Australia (at least at competent level).
•  Qualifications – you must have post-secondary qualifications and your skills must be assessed by the relevant assessing authority as suitable for your nominated occupation. Nominated occupation – when you apply you nominate a skilled occupation, which fits your skills and qualifications. Your nominated occupation must be found on the Skilled Occupations List.
•  Recent work experience – you must have been working for 12 out of the last 24 months in your nominated occupation.
•  Australian qualification exemption – you do not need to meet the work experience requirement if you have completed an Australian qualification less than 6 months before lodging your visa application.
•  Skills assessment – before you apply, you must have your skills assessed by the Australian assessing authority designated to assess your nominated occupation.

Skilled Occupation List

The Australian Workforce and Productivity Agency (AWPA) has considered labour market, education and training, migration and general economic and demographic data and stakeholder submissions to develop its advice to the Department of Immigration and Border Protection on the 2015 Skilled Occupations List (SOL).

Applicants for Australia’s Skilled Migration programme must have experience in an occupation listed under SOL schedule 1 Or CSOL schedule 2, this list is effective from 1 July 2015.

Applicants who require a skills assessment as part of their visa application must contact a relevant assessing authority directly to obtain a skill assessment. The assessing authority will provide all necessary applications forms and associated information relating to the assessment. There will be a charge by the assessing authorities for the assessment.
